I suspect that the behaviour you're suggesting wouldn't really comply with Apple's Human Interface Guidelines. If you look at Apple's own apps, the menu items are stable/constant, and if they change then it's limited to being ghosted/unghosted or checked/unchecked. I've never seen an entire submenu appear/disappear depending on some external factor.
In Synergy the item for launching/quitting iTunes is inside the submenu. One thing that your request has brought to my attention is that the other items in the submenu should probably be ghosted when iTunes isn't running. As for replacing the entire submenu I don't really agree, but let's leave this bug report open and see if other users vote for it. As always, if enough people want something, then I'm prepared to implement it even if I don't personal think it's a good idea!
